Your use of this web site (the “Site”) is governed by the policies, terms, and conditions set forth below. Please read the following information carefully. By using this Site or submitting an order for products or services, you indicate your acceptance of, and agreement to be bound by, the terms and conditions set forth below. If you do not agree to these terms and conditions, please do not use this Site and please do not submit any orders for products or services.

These terms and conditions may be changed from time to time. It is your responsibility to periodically return to this page to review the terms and conditions for changes and revisions to these terms and conditions. Revisions take effect upon the posting on the site. Your use of this web site will constitute agreement to such amendments.

Galaxy Mall is a subsidiary of PlanetThommy.com. Your bank transaction will reflect PlanetThommy.com. This policy is written using the PlanetThommy.com and Planet Thommy name and shall have the same reference to Galaxy Mall and www.galaxyshoppes.com.

Policy: PlanetThommy.com reserves the right to make variations to this policy to preserve customer satisfaction on a case by case basis. A variance of policy does not change or modify the written policy in place and it is not to be expected on a repeat basis.

Pricing: Prices and availability are subject to change without notice. Some items in our store are priced below the manufactures advertised price agreement. These items will not show a price and will be marked “Click to see price”. Simply click on the link to see the price. Your order will reflect this price.

Some products may come with a manufacturer’s Money Back Guarantee (MBG). In these instances, please directly contact the manufacturer. Please contact us if you need contact information.

Some products are not returnable under any circumstances - please see the important exceptions outlined below.

Back Orders: Occasionally an item ordered may be on Back Order from the manufacture. We will ship items in your order that are in stock and notify you of items that are on back order. Back Ordered items will be shipped with-out additional shipping charges.

If the anticipated shipment of Back Ordered items will exceed 5 business days we will notify you of the anticipated ship date. You have the right to cancel these items with-out penalty if this happens.  

Special Orders: We do carry items that require a special order with the manufacture or warehouse. These items are plainly marked as a special order and will have anticipated shipping times posted. Special orders are charged to your credit card when the order is placed. You will receive order acknowledgement after your order is accepted and a date of anticipated shipping with-in 2 days after that.

Please note: Special orders are not cancelable and are not refundable.

Shipping: We make every possible effort to ship your order with-in 24 hours depending on the warehouse location. We will email you a final invoice and shipping tracking information once your order leaves our facility. Since we do ship quickly if you wish to cancel an order you must do so with-in 2 hours from the time you placed it. Once a shipment is in the warehouse system it cannot be canceled. For the purpose of definition an order has shipped once the shipping label is printed.

Insurance is optional however you will be shipping at your own risk. Our standard shipping terms are "FOB Origin, Freight Prepaid & Add".  A FedEx or UPS shipment has $100 coverage as standard.

Residential Address-We ship your packages via FedEx Home Delivery® service or UPS depending on the warehouse location. Shipments outside USA maybe subject to Import Duties. These fees are not included in shipping costs and will be billed to you directly by the carrier.

A shipment may require a signature depending on the value of the shipment and\or the ship location. A shipment is considered delivered if the carrier provides confirmation of delivery. If you require a signature delivery please note this on your order and we will comply with the request at no additional charge.

Sales Tax: PlanetThommy.com collects sales tax for orders shipped with-in the State of Florida; Seminole County. If the payment of sales tax(es) is required by your state or municipality the customer is responsible for submitting and paying for those sales taxes not collected by us.

Communication: PlanetThommy.com prefers to communicate with you by email. We will send all of this communication using the address you have on file with us that is associated with the buyer account. Please insure that e-mail correspondence is cleared in spam mail filter software you or your ISP may have on your email account. Check your spam or junk mail holding folder that does get trapped in error. We pride ourselves in providing you excellent customer service. Emails are typically answered with-in 2 to 4 hours during our normal business hours.

Unauthorized or Refused Returns: PlanetThommy.com will not accept unauthorized returns or exchanges. A shipment that is refused shall fall under this policy. Packages without a Return Authorization Number will be refused upon return to our warehouse. PlanetThommy.com will impose a 20% restocking fee plus any applicable shipping and handling charges for refused shipments by the customer. In the case of “Free Shipping” the actual cost for shipping will be calculated into the calculation on all returns.  Additional charges may apply if the merchandise is not returned in 100% complete condition in the original, unopened packaging. To complete a return, you must contact us to obtain an RMA (Return Material Authorization) number before returning your product. For faster service, please have the following information ready when contacting us for an RA number: Customer name, order number, item number and the reason for return.

Defective Returns: Defective returns will be accepted for exchange or repair, at our discretion and with-in the policy of the manufacturer, within 15 days from the shipment date. No refunds or credit will be granted after 15 days, the terms of the manufacturer’s warranty apply. Please contact the manufacturer directly. (Please see important exceptions listed below). A product must be diagnosed “defective” by the manufacturer. You can get manufactures product support contact information in the product literature that came with your purchase or by contacting us and we will be glad to provide it to you. In most cases the manufacture will correct the problem with you or direct you to a repair facility.
Please note that in some cases the manufacture will not allow us to handle warranty or defective product issues and requires that such issues be directed directly to their support department.

Special Return Policy for Reconditioned Products: Reconditioned defective returns will be accepted for exchange or repair, at our discretion, within 10 days from the shipment date. No refunds or credit will be granted after 10 days, the terms of the manufacturer’s warranty apply. Please contact the manufacturer directly. A product must be diagnosed “defective” by the manufacturer. You can get manufactures product support contact information in the product literature that came with your purchase or by contacting us and we will be glad to provide it to you. In most cases the manufacture will correct the problem with you or direct you to a repair facility.

These products have been previously sold and returned, reconditioned by an Authorized Service Dealer and repackaged for selling purposes.

Typographic, Photographic & Technical Errors: Although we do our best to achieve 100% accuracy, occasionally errors & inaccuracies do occur. Should you encounter an error or inaccuracy, please inform us so it can be corrected. Products & packaging depicted may differ from stock available at time of shipment. We reserve the right to substitute equivalent items.

Warranty Disclaimer and Limitations on Liability: PLANETTHOMMY.COM PASSES THROUGH TO ITS CUSTOMERS ALL MANUFACTURERS¹ WARRANTIES AND GUARANTEES THAT ARE PROVIDED FOR THE PRODUCTS IT SELLS. PLANETTHOMMY.COM MAKES NO ADDITIONAL OR INDEPENDENT WARRANTIES. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, PLANETTHOMMY.COM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

PLANETTHOMMY.COM SHALL UNDER NO CIRCUMSTANCES BE LIABLE FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL (INCLUDING LOST PROFITS OR OPPORTUNITIES) OR PUNITIVE DAMAGES, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Disputes: Any claims against PlanetThommy.com relating in any way to your purchases from PlanetThommy.com shall be submitted to confidential arbitration in Winter Springs, Florida. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator¹s award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise. In any such arbitration, the parties shall be responsible for their own costs, expenses and attorney¹s fees. In the event that this arbitration provision is unenforceable, any litigation regarding this agreement or any transaction between the customer and PlanetThommy.com shall be brought in the state or federal courts located in Seminole County, Florida, and the customer hereby agrees and submits to such jurisdiction and venue as exclusive and proper.

Governing Law: Transactions between you and PlanetThommy.com, and any disputes arising between you and PlanetThommy.com related to any interaction between you and PlanetThommy.com, including but not limited to claims relating to the content of its catalogs and Web site, shall be governed by and construed in accordance with the laws of the State of Florida without regard to the laws regarding conflicts of law. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

Title - Risk of Loss: Title to items being purchased passes from PlanetThommy.com to purchaser at the time of shipping. Customer takes on full liability for safety and validity of delivery address given to us at the time of purchase. PlanetThommy.com will not incur any forwarding costs on shipments. PlanetThommy.com shall not be responsible for damages or delays resulting from Acts of God, war, riot, seizure, terrorist activities, embargo or other acts or events outside of the reasonable control of PlanetThommy.com.

Return Procedures: You may return new, unopened items sold and fulfilled by PlanetThommy.com within 30 days (5 days for open box or refurbished products) unless stated otherwise in the product description for a full refund less the original shipping changes, return shipping charges and an additional restocking fees (20% unless stated otherwise) if applicable. In the case of a Free Shipping or a Shipping Discount offer the actual cost for the initial shipping will be deducted from the return.

Returns for exchange or store credit will not incur a restocking fee; however due to the high cost of shipping the deduction of the original shipping charges and return shipping charges condition stated above still does apply.

Merchandise packaging that has been opened or merchandise that has been installed or used can not be returned. Such items returned will be placed in a holding bin and the customer contacted with the cost of shipping and handling to return the product to them. If after 30 days from this notification the customer does not contact us and pay the return shipping the merchandise will be considered abandoned and disposed of as necessary by PlanetThommy.com.

You should expect to receive your refund within four weeks of giving your package to the return shipper; however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return from the shipper (5 to 10 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 10 business days). We'll notify you via e-mail of your refund once we've received and processed the returned item. Refunds will be made to the original charge card if used in making the purchase.

The following items cannot be returned to PlanetThommy.com for any reason. It the product is under warranty please contact the manufacturer for information on how to get the item repaired or replaced

  • Hazardous items that are gas-powered or contain flammable liquids.
  • Any product missing the serial number or UPC.
  • Software products. (other than defective exchange)
  • Media of any kind. (other than defective exchange)
  • Certain articles of clothing regulated by health codes. i.e.: Undergarments, swim wear, personal hygiene items, Opened bed linens, Opened towels of any sort, Cleaning chemicals or solutions, Toiletry training, Toiletry or bathing assistance products and breathing assistance products.
  • Jewelry
  • Product that is missing packaging, loose parts or manuals as it was shipped
  • Any product that has been altered, installed or that has been damaged while in your possession by secondary handling.
  • We will refuse to handle any return claim to your account that is related or not; or that is ongoing, in the present or in the future if a fraudulent attempt is made to return as new an older or same product that was not purchased and fulfilled by us and related to the invoice pertaining to the return.

Third Party Service Contracts: PlanetThommy.com is a reseller of various service contracts issued by and performed by third party service providers. We are not the providers of the services described in those contracts and the third party service provider is the only party responsible for performing, or arranging for performance, of those services. You agree that the third party service provider is solely responsible for fulfillment of the service obligations and you agree that you will look only to the third party service provider for any loss, claims or damages arising from or relating to the purchase and performance of those services. You also agree to release PlanetThommy.com from any and all claims arising from or relating to the purchase and performance of the services to be provided by the third party service providers. These services may be subject to sales tax. To the extent that such taxes are collected by us, they are collected solely on behalf of the issuer of the service contract in PlanetThommy.com’s capacity as an independent sales agent for the service provider.

Additional Information: PlanetThommy.com policies are subject to change without notice. We do our best to ship all orders as rapidly and accurately as possible. However, PlanetThommy.com is not liable for late or delayed shipments or system failures. Title to items being purchased passes from PlanetThommy.com to purchaser at the time of shipping.
